This is a legal agreement between you and TriStar Creations, LLC. By purchasing a service you are stating that you have read and understand the terms and conditions set forth and is indicating your acceptance of this legal agreement and you agree to be bound by the terms. You cannot become a client unless you have accepted each and every term hereof.
Refunds and Cancellations:
You may cancel at any time for any reason with no penalties. Payments under a month to month contract will not be refunded. If the account is under a yearly contract, you may cancel your account and request for a refund of the unused month's service fee. Over usage of your account does not apply to such refunds. Cancellation includes the removal of all files on the account.
Service Refusal:
TriStar Creations, LLC reserves the right to refuse service to anyone for any reason, and to cancel any accounts for any reason. Upon such account termination, a customer is entitled a refund of the month's service fees and a minimum of 5 days notice.
Maintenance of Storage Data:
TriStar Creations, LLC shall have no responsibility for and does not guarantee the integrity, completeness or availability of Storage Data residing on TriStar Creations, LLC equipment. You are responsible for independent backup of Storage Data stored using TriStar Creations, LLC services. You agree to assume all risk of loss of such data. You agree to defend, indemnify and hold TriStar Creations, LLC harmless for any loss of data, whether on Your equipment or through TriStar Creations, LLC services, arising out of or resulting from use of TriStar Creations, LLC services, including use of software provided by TriStar Creations, LLC, if any.
TriStar Creations, LLC may, but shall not be required to, delete Your Storage Data after the termination of this Agreement.
Choice of Law and Venue:
TriStar Creations, LLC services are managed from its offices within the State of New Mexico, United States of America. TriStar Creations, LLC makes no representation that its services are appropriate or available for use in other locations. If You choose to access this site from other locations, You do so on Your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. All matters with respect to this Agreement, including, without limitation, matters of validity, construction, effect and performance shall be governed by the internal laws of the State of New Mexico applicable to contracts made and to be performed therein between the residents thereof (regardless of the laws that might otherwise be applicable under principles of conflicts of law). Any action or proceeding related to the subject matter of this Agreement shall be venued in Las Cruces, new Mexico. You hereby agree to submit to personal jurisdiction in the federal and state courts located in Las Cruces, New Mexico.
This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods. |
